The Fabbri Amarena jar, as well as the packaging of all its products characterized by the unmistakable blue and white decorations, cannot be imitated in China. The People’s Court of the District of Shanghai Yangpu has in fact recognized the high reputation of the packaging of the Bologna-based company – specialized in sour cherries for the confectionery industry.
The news, as well as official recognition that Fabbri’s products have “a famous packaging that enjoys a high reputation” in China – an accreditation that Fabbri 1905 shares with very few other Italian brands – has a considerable value for all Made in Italy F&B.
“This ruling is the proof that the work done by determined entrepreneurs, supported by the Italian and Chinese diplomats can achieve positive results and that today international brands and Made in Italy are fairly protected also in China” says Nicola Fabbri, president of Fabbri China.
The decision of the Chinese Court puts an end to a legal dispute that has seen the Italian company committed since 2019 to defend the intellectual property related to its packaging from an attempt of imitation by a Chinese confectionery company. The pronouncement in favor of a foreign company, unusual in the Chinese practice so far, is an important legal precedent.
